I was a victim of domestic abuse and I currently have an emergency temp custody order. The real fight has yet to begin. In the meantime, it's been 2 months and nothing has been established. My husband hasn't forwarded a cent and I was a stay at home mom without any income. Our expenses were modest but now I have had to apply for social assistance to get by because I haven't gotten any support yet. I have a feeling he will pay the minimum which in Canada is only a few hundred a month even if a man has a decent salary. Since our expenses were a few thousand and day care is expensive here, what are my rights??? My legal aid lawyer says that I will not be able to move out of the city I'm in whereas he is far out living in a property he owned as an investment. My family and friends are out of the province. I will end up living in poverty alone while his lifestyle doesn't change, yet he can prevent me from moving and being able to afford the place we're in now? I need advice, especially from someone on Canada who's been through all of this. I am not pregnant but my kids are 1 and 2

Not much of a response in a week of waiting - not many Canadian lawyers on the forum. This is a tough situation, though not uncommon. You should congratulate yourself for recognizing abuse and deciding to leave. Many can't bring themselves to do that. You may be able to find a spouse abuse shelter which will host you for a while. After that, it's back to the parents, partner with another woman in a similar situation, or dump the kids on his doorstep and let him find out how easy it is. That last solution is one of desperation, and you have to consider the effect it will have on the kids. Sympathy, and good luck!
