i was just wondering if a guy needs permission from his kids mother to sign his rights over or can he just do it? i always thought you could just do it but someone told me you needed permission from her. also, how do you go about doing it? thanks

Well even if he wants to sign his rights over and she agrees the state will not let them just sign over their rights unless there is another man to adopt and act as the "father". My daughters father tried to sign his rights "away" not over because there was no one to sign them over to and I agreed however in my state it is not an option. The only reason he wanted to sign his rights over was to get rid of his $14,000 child support debt so he could get his license reinstated for a good job he was offered, so I am glad he couldnt but at the time I felt like if thats what he wanted we would be better off with out him. It does depend on the state though, there was someone else on here I was talking to in a different state who was actually going through an attorney and doing it and there wasnt anyone else to adopt the baby, so you have to check your state laws. I'm pretty sure he cannot a__sign his rights to another person if the mother has custody. He cannot force the mother to share custody with a person of his choice. Besides, some states don't even recognize it as shared custody if only one person has custody. You have to go to court to establish custody.

My kids father signed over his rights and the judge said well you still have to pay child surpot and he is.
