I have a question about my sons father and his rights. I just want to know if there is anyway to take the fathers name off of the birth certificate. He gave up custody 100% and 100% rights as well. But I am not sure that is correct. Per the court doc's. it says he can claim my son on his tax return every other year. So doesnt that mean he still has rights? My son was months old when all of this happened. Per the court order he has to provide insurance and pay child support. But he quit his job and hasnt had insurance for my son in almost a year. I have received child support on and off. Quite frankly I dont need his child support but I do it for my chids sake of having his father around. Though he has not played any role in months. Is it possible at all to remove him from the birth certificate since he has no custody and supposedly no rights? I am just confused I hope some mothers can help. Thank you.

My mother works as city employee doing all the birth and marriage certificates for our city. According to her it can be changed but you would have to have a judge give you permission. It has to be court ordered. What state do you live in?
