Can you claim unemployment while on FMLA if sick, vacation and personal days have expired?

I don't know for sure....but I'm thinking the answer would be no. to even have FMLA you have to be employed, which would disqualify you for unemployment. call the unemployment office and ask though.

Check out laborlawtalk.com then click under maternity, then you can find answers to your question.

No, you can collect one or the other.

no - you are still employed - just under the protection of FMLA... If you claim unemployment - you risk losing your job and FMLA won't apply - one or the other....

No, because you are still employed - FMLA guarantees that you are employed. Also, you can't get unemployment compensation if you quit - it has to be Through No Fault of Your Own.
